TERMS OF ONLINE TICKET SALES
The present terms of sale define the relations between consumers purchasing admission tickets to Chaplin's World online, and the company By Grévin SA, a société anonyme (joint stock company) incorporated under Swiss law, with a share capital of CHF 200,000, with their headquarters at Route de Fenil 2, 1804 Corsier-sur-Vevey Switzerland, registered under IDE number CHE-100.468.361 and federal number CH-660.0.618.000-4.
The purchase of any online admission ticket to Chaplin's World from By Grévin SA covered by the scope of the present terms implies unconditional acceptance of these terms, notwithstanding any provision to the contrary.
1. DEFINITIONS
The terms starting with a capital letter are defined for the present purposes as follows:
- "Buyer": Consumer purchasing Ticket;
- "Ticket": document granting admission to Chaplin's World, on one or more determined or undetermined dates.
- "Terms": the present Terms of sale;
- "Consumer": physical person not acting for purposes not related to a trade, business, craft or profession;
- "Chaplin's World": an entertainment facility dedicated to actor Charlie Chaplin, located at route de Fenil 2, 1804 Corsier-sur-Vevey Switzerland, operated by By Grévin SA;
- "Website" : the Chaplin's World website www.chaplinsworld.com.
2. SCOPE
The Terms apply exclusively to online Ticket sales to Consumers.
3. TYPES OF TICKETS
The types of Tickets and their characteristics are detailed on the Website.
4. TICKET PURCHASES
To purchase a Ticket online, the Buyer must connect to the Website and fill in the fields required to place an order.
Once the transaction has been finalized, the Buyer receives an email confirming the purchase, as well as the Ticket in electronic format.
5. PRICES
Ticket prices, in Swiss francs, including tax, are listed on the Website. Prices may be subject to occasional promotional offers.
Ticket prices are based on the tax rate applicable on the day the Terms enter into force. They may be changed at any time if tax rates change.
Ticket prices do not include meals, parking or any personal expenses on Chaplin's World facility premises.
6.TERMS OF PAYMENT
Tickets bought on line must be paid in full at the time of purchase.
Payments made on the Website are protected by an encryption process that ensures the security and confidentiality of the data.
7.DELIVERY OF TICKETS
The Tickets are sent by email to the address given by the Buyer during the purchase.
By Grévin SA does not send tickets by postal service, fax or text message.
8. MODIFICATION EXCHANGE AND REFUND OF TICKETS
Tickets even unused, may not be changed, exchanged or refunded.
9. VALIDITY OF TICKETS
To be valid, a Ticket must be printed out on blank A4 format paper.
Tickets grant access to Chaplin's World facilities open to the public on the day of admission of the Ticket holder.
By Grévin SA reserves the right to refuse admission to Chaplin's World, or any of its facilities, if the Ticket is illegible, altered, damaged, incomplete, partially printed, or falsified.
Ticket holders exiting Chaplin's World may not be readmitted with the same Ticket.
10.EFFECTIVE DATE OF THESE TERMS
The present Terms apply to ticket purchases as of 1st January 2016.
11.CHANGES IN THESE TERMS
By Grévin SA reserves the right to change all or any part of the Terms, including Ticket prices, without prior notice. Any changes will go into effect on the date given in the Terms.
12. PROCESSING OF PERSONAL DATA
In accordance with Articles 8 and 9 of the Swiss Federal Data Protection act of 19 June 1992, personal data gathered from the Buyer is used to manage admission to Chaplin's World, and if the Buyer so agrees, to send him or her promotional offers. If the Buyer so agrees, his/her data may be shared with By Grévin SA's business partners.
Under Swiss law, any person whose personal data is collected by By Grévin SA has the right to access, correct or demand the removal of this data. 13. LIABILITY
By Grévin SA declines any liability for expelling any visitor from Chaplin's World premises for having breached Chaplin's World rules. The said visitor will not not be entitled to claim any compensation or Ticket refund.
By Grévin SA reserves the right to refuse a Ticket holder access to Chaplin's World or any of its attractions, shows, or facilities on the chosen day of the visit, for reasons such as heavy attendance, inclement weather, or maintenance operations, without this entitling the Ticket holder to claim any compensation or Ticket refund whatsoever.
By Grévin SA, who is bound only by an obligation of means with regard to online sales, may not be held liable for any damages inherent in using the internet network, such as interruption of service or presence of a computer virus.
14. INSURANCE
By Grévin SA holds a civil liability insurance policy with the insurer Axa Assurances SA (Winterthur; policy No.15.313.841). This insurance policy covers By Grévin SA's civil liability for: bodily injury or material or immaterial damages caused to customers or third parties resulting from error or negligence in their business as an entertainment service provider, up to CHF 10,000,000- per event.

16. APPLICABLE
The present Terms are subject to Swiss law.
